family and this community and the nation. if it is an inappropriate arrest had not occurred, we wouldn't be going through this pain. >> reporter: prosecutors say that there wasn't enough evidence to formally charge barry with stalk an estranged girlfriend, donna watts brightau brightaupt. park officials said in the statement that they believe they had enough evidence to arrest barry but it was up to prosecutors to bring a case. barry didn't accept that and said he had pursue -- will pursue more explanation from the park service. >> the point i'm making here, that this inappropriate arrest, led to consternation and led to embarrassment around the nation and led to all of this and the buck ought to be put at this inappropriate arrest. and i'm expressing it and deep and strong language. >> reporter: the park police say their report on last saturday's incident may be released tomorrow. wendy, back to you. >> tom sherwood, thank you.

recent escap at a youth detention center prompted the firings of several employees. this afternoon mayor adrian fenty said that five staff members at the new beginnings youth development center were terminated. he said two others, suspended. the facility's superintendent has beendemoted. the d.c. owned property is an anne arundel county, worst off enders escaped last week and another teen broke out last month. >> there were staff on duty and who either should have or could have or just plain did not do everything that they could have and should have done to prevent these escapes. >> anne arundel county executive john leopold has offered to notify anybodyors about any future security breaches at the center through an e-alert system. metro's putting a new zero tolerance policy into effect when it comes to bus drivers and train operators who text on the job. the announce many comes after

video surfaced online of a metro train operator texting while working. chris gordon has more on the new policy from northwest d.c. tonight. good evening. >> good evening. until now, the metro operators had been three strikes and you are out. first violation, one week suspension, and the second, two weeks, third, could be fired. but from now on, it is one and done. one violation and termination. we begin our report tonight with new pictures, given to news4 by a metro passenger. eddie davis snapped three pictures of the operator of this orange line train on the morning of september 18th, 2007. >> i noticed that the operator took his eyes off the tracksnd was actually texting on his cell phone. and just said, oh, my god. you know. so -- what i did immediately was i pulled out my cell phone and i said i'm going to have to take pictures of this. >> reporter: news broadcasts showing this video of a metro

slump. new reports out today find that mall-based stores have been hit especially hard as families look for bargains. the sluggish sales may mean retailers will keep deep discounts in places back-to-school shopping season gets under way. that may be good news for shoppers but the news has stocks struggling stay in the green. dow ended up on the day five points at 1883. nasdaq also gained five points today. meanwhile, the s&p was up three points. the path out of bankruptcy protection for general motors appears to be clear. a judge's order a plan to sell most of the assets to a new company wants to take effect at noon today, a last-minute appeal was filed. but it is not expected to block the sale. once the deal goes through, gm will become a new government controlled company. underperforming assets are being dropped in the much leaner company will sell a smaller crop of cars and trucks. bernard madoff decided not to appeal his 150-year sentence for investment fraud.

madoff cheated investors out of nearly $65 billion in a ponzi scheme that lasted at least 20 years. a judge gave him the maximum sentence last week. his attorney said today his 71-year-old client will not appeal the sentence. the lawyer clind to give a reason. last week u.s. marshals revicked madoff's wife, ruth, from their $7 million penthouse in manhattan. the apartment and all of its contents now belongs to the government. minnesota's new senator al trainen met with supreme court nominee judge sotomayor today. the democratic senator says he is looking forward to examining sotomayor's qualifications. franken, who was just sworn in this week, said he feels like the president has chosen a person with an impressive record of accomplishment and senator franken will be taking part in the judge's confirmation hearings which begin next week. republicans said today that they intend to have a white firefighter testify against her in the confirmation hearings. still ahead on "news4 at 6:00," health officials are

five young people were killed today. amtrak train hit their car and happened at a train crossing in suburban detroit. the crossing has a gate and flashing lights that appear to have been working. witnesses tell police that the car drove around the gate as the train approached. investigators believed that all of the victims are teenagers that amtrak train had just left detroit and was heading to chicago with about 170 people onboard. no one on the train was hurt. although one passenger did suffer an asthma attack. right now the government is preparing for a second outbreak of the swine flu. today representatives from every state gathered at a swine flu summit here in bethes did a and

talked about when a vaccine will be ready, who is going to be the first to receive it. tracie potts with our report. >> reporter: clinical trials for the hisn1 vaccine start one month from now. the obama administration expects to spend $8.5 billion to produce it. and tens of millions of doses should be ready by mid october. >> we want to make sure that we are not promoting panic but we are promoting vigilance and preparations. >> reporter: president obama called in from italy today to address the 500 state and local officials now learning what they need to do. >> you can't wake up in october and say oh, my. we have a really serious problem on our hands. we want to use the summer months and to really get ready. >> reporter: the biggest concern, children. they will get the first vaccine. >> somehow the young people are getting preferentially -- the median age of people who are infected with the h1n1 is in the teens which is unusual for flu.

swelled to the thousands and they defied security forces who charged them with tear gas and batons. selected video clips were shown on the english language feed of iranian state tv called press tv. d the broadcasters insist that there were no major protests in iran today. the deadly government crackdown on post-lexapro tests began 11 days ago. meanwhile in china, 8,000 troops marched through the city. the massive show of force was an au pairent effort to prevent further violence there. more than 150 people have been killed this week and riots between two ethnic groups and muslim and the chinese. more than 1100 people have been injured p. hundreds had been arrested. today china's top communist leaders vowed to maintain order and turkey's president called on the united nations to look into the violence. the turks share an ethnic brond. china immediately oppose ed turkish request. >> tbombings in two cities killd

more than 50 people. this is the most bloodshed in a single day since u.s. forces withdrew from urban areas some ten days a. in baghdad roadside bombs killed 13 today. one of the bombs went off near an outdoor market and that bomb followed by a second bomb that targeted bystanders. and in the city oftal far, a coordinated attack by two suicide bombers killed 38. the victims included investigator and the city's counter terrorism task force. 25 people were killed in afghanistan today when a disabled truck filled with hidden explosives blew up on a highway outside of kabul. more than half of the victims were children and walking to school. that truck appeared to be loaded with timber. it turned over on the highway last night and police were trying to clear a nearby traffic jam this morning when explosives hidden beneath the timber went off. it's not clear if a remote was used to trigger the blast. the incident is a grim reminder that the scope of the conflict

in afghanistan is widening. u.s. military officials say that there were three times as many roadside bombs in afghanistan than in iraq last month. a third wave of cyber attacks hit seek today and caused a little disruption. south korea officials deliver ad briefing on the attack and say six of the seven affected websites are back up and running in a short time because the sites took precautions to fend off the cyber assault. the attacks were the latest in a series that xwan on the fourth of july p targeting high-profile sites such as the white house and the secret service and the office of south year's president. coming up on news4, a disturbing story that what police say was a grave tampering operation and at an hayes toric cemetery. >> warning for cyclists in loudoun county after several people taking part in a charity ride got ticketed and also received points on their liesinses. >> bob will be back with a check on the weeke forecast.

how much moisture, humidity is in the air. when it is below 60 like it is right now, it is mity comfortable. especially in july. usually in july we are talking about the mid to high 60s and even 70, oppressive stuff. look at the dew points right now. not only is it dry over us but look at the areas like chicago and usually a rather h and humid. heading into the middle of july. here is where it is humid. current dew point temperatures. not the air temperatures. look at the temperature in dallas. 102 degrees. austin, texas, starting a record 10 degrees. so that's where the scorching heat is. and not only the heat but with the heat index in dallas, 106. it has been day after day of dryness and sometimes you get into the drought pattern and the ground is so dry this no moisture goes into the atmosphere and the drought intensifies and the heat intensifies. those are the areas south texas and that are still having a terrible, terrible drought. exceptional drought and with it also that is the spot getting

exceptional heat with a records and many records a few days ago 108. here is the overall pattern now. just beginning to move a little bit more to our north. we still had that high pressure in on us. and down to the south, that is where a stationary front has been and there have been showers and thundershowers, fortunately, though, it did clear out early this morning. this is what the folks in palm beach saw at 6:00 this morning. remember, we have seen the international space station. but there it was passing, apparently right across the moon. it was not near the moon. but what a sight to see. international space station and because they were farther south, they were able to see it pass right in front of the waning full moon. 6:00 this morning. look at the rains that once again come into florida and over an inch and a half of rain in sarasota, florida, where the temperature is 73 degrees. vero beach, well over an inch of rain. it has been really wet. as you can see, down in florida, at least it was clear enough this morning. that will be moving out and as

we get later into the weekend, the jet stream begins to move to our north, we will get the high pressure that has been over us and gradually moving up to the north and northeast. then as we get into late friday and saturday, then the winds will be turning a little bit more into the south and southeast and humidity will be coming in and especially as we get into saturday and with it, with the weather front approaching, maybe some afternoon showers or a thundershower. temperatures tomorrow, though, once again, below average. in the meantime, for this eving, with the cloud out there, it is very pleasant and the humidity certainly at bay with temperatures dropping into the mid to high 70s. once again, beautiful evening to be outside. we will see the clouds around overnight tonight. because we have more of -- little bit more of an east and eventually a southeastly wind. look for partly cloudy skies tomorrow. still comfortable air for the most part. may notice the humidity a little bit. but i think it really will be cranking up until we get on into saturday and sunday. still comfortable and uv index tomorrow is once again going to be high. but temperatures, againing only

we are back now with a look at some of the stories making headlines tonight. >> important the first time since his arrest marion barry is speaking out about what he calls an embarrassment during a july fourth weekend. u.s. park police arrested barry saturday night for allegedly stalking a woman he knows. barry says the officer was wrong to arrest him. prosecutors say they will not go forward with the charges. >> metro has a new policy and zero tolerance policy when it comes to mobile phones and bus and train operators. under this any operator caught using a mobile phone on the job will be fired. this comes after video was found on the internet showing a train operator texting as the train moved down the tracks. >> president obama continues his trip italy today attending the g-8 sum and it reiterated his goals for fighting climate change and opening up trade. meanwhile, back in the states, democratic party leaders defended president obama's stimulus plan saying that it will take some more time before the economy starts growing. republicans say the stimulus plan is not working.

coming up, this half hour, "news4 at 6:00," new information about what led up to former nfl quarterback steve mcnair's death. also, montgomery county police say a man who was attacked by gang members has died and people who took part in the charity bicycle ride in loudoun county not only got tickets, they also lost points on their driver's licenses. there is a disturbing story tonight that comes from the suburbs of chicago where four workers at a historic cemetery are accused of digging upve g gs re d anselling the d otpls. 030s gve ra y tt ha at tha cemeteryenavbee tampered with. >> reporter: the remains of as many as 300 people buried at the burr oaks cemetery south of chicago have been dug up and their gravesites resold. and relatives are outraged. >> i have 23 family members out here. and i have gravesites that haven't been used. headstones missing. this is ridiculous. this is sacred ground.

>> reporter: authorities say the dug-up remains were dumped elsewhere, often in crude fashion. >> for graves stacked on top of each other, some of the ways in which that was done has been explained to us since literally they were pounded -- pounded the other one down and put someone on top. >> reporter: they say the gravesites chosen were extremely old. and appeared not to have regular visitors. the cemetery's manager and three of her grave diggers have been charged with felonies. and more arrests are possible. >> this crime is -- it is a whole new dimension and -- that shows us what length people would go through for financial gape. >> reporter: hundreds that have relatives buried there were asked to identify gravesites at the cemetery which is the final resting place for prominent people like lynch ing lynching till. >> special held for the graveyard thieves. >> reporter: authorities suspect the scheme has been going on for

years. >> emil till's grave was found there and found to be intact. authorities can't say weather dinah's gravesite was disturbed. >> we are learning more leading up to the murder of steve mcnair. police say kazemi was a deeply troubled woman who was losing control. investigators say early thursday morning, kazemi was pulled over in nashville on suspicion of dui. that afternoon, she bought a gun in a parking lot and of the dave and busters restaurant where she worked. kids my also asked to leave work early friday, around 10:00 p.m. that was the last time she was seen alive. police believe she was concerned about her finances and her relationship with mcnair who she believed was in a relationship with another woman. not his wife. >> many things were stressing her. one of the stresses was whether or not her relationship was unraveling with mr. mcnair.

residence and chase him away. and brutally beat him and one of those men stabs him in the head. >> reporter: neighbors are still shaken by the incident. >> i heard it first. it sounded like a party. like -- a lot of noise. >> reporter: it was no party. it was a savage beating, at least six on one. >> i saw the dude, the victim, and fight two guys, trying to keep them off of him. you know, throwing trash trash cans and trying to get them away. next thing i knew, on a rush of them, like ten of them, came from up that way. and he -- ended up down here where they got him. >> reporter: the victim died earlier today and he had fallen just yards from his own home. police say edwin had no gang affiliation. >> he was attracted to young ladies on the front porch, tried to engage them in conversation, and they weren't interested in speaking with him. >> reporter: police arrested 20-year-old christian salmoran, bud bay, 18-year-old anthony rosito, 21-year-old jose vasquez. also in custody, guerrero and

jose hernandez, 16 years old. 17-year-old kevin miranda, all believed to be members of the latin kings, all being charged as adult. >> they always say that not in my neighborhood. it can't happen in my neighborhood. like i said, it is prevalent and all over. >> reporter: derrick ward, news4. >> the suspects are all being held witho bond and facing charges that include first-degree murder and first-degree assault and conspiracy. a couple out walking their dog last night was attacke with a stun gun and robbed. it happened on ridge view court in lake ridge, virginia. princeilamli amcounty ce say threepoea m wenngri ng masks walked up to a r-29ea-yold man and 33-year-old woman and eddeeandma money. nd when the man told the us spects s any, he swa e tased. the woman told the attackers there was money in their t aren ttmand tany he were forced back to their home and robbed. we have breaking news now. it comes from capitol hill. a democratic official says that illinois senator rand burris will not run for a full senate term in 2010.

a young man has finished up a 700-mile journey to help children impacted by homelessness. five years ago zack bonner started collecting bottles of water in his red wagon. for kids who lost their homes when hurricane charlie hit there. he's 11 now. in april he decided to walk all the way from atlanta to d.c. to raise awareness of the 1.3 million children who are homeless in america. he said it is tough but he didn't give up. >> there are days that you

chris samuels putting smiles on kids' faces this summer. the six-time pro bowler is holding a star-studded football camp in bowie high school. chris daniels and his pals, including redskins quarterback jason campbell, are coaching two camps and through next week. samuels is sharing valuable knowledge to kids 7 to 18 years old. the offensive tackle is not just teaching kids skills on the field. he's giving them lessons how to study films. samuels says he is getting a kick out of this coaching thing. >> it is funny. those guying be looking up to me and i remember me looking up to a lot of guys growing up and just to bring joy to these kids and teaching them the game of football, it is a beautiful game. tell you what. four, five of these kids got a chance, lot of potential. just trying to help mature and bring it out of the kids. by that time i will be retired. >> daniels doing big things in the community. his voice just powers it. like he listened. >> it sounds like he could be a coach. >> yeah. he might be. you never know. he got the credentials. when we come back, we are going to take a look at whether
