breaking news in the east bay tonight, where police are on the scene of a double shooting. good evening, i'm julie haener. >> i'm frank somerville. that shooting happened in may ward, not far from a fast food restaurant. the scene is on west wenten avenue, not far from a jack in a box. jana katsuyama is there with what witnesses are saying. >> reporter: police are still trying to figure out what's going on. i want to step aside, this is just in the past two minutes. literally, they took the two vehicles that were involved

that had crashed into one of them, that fence that you see, leaned over here on west wenten. the police vehicles are still here, but just about two minutes ago, they are reopened west wenten to traffic after it had been shut down for more than four hours. they called in a tow truck to take them away. hayward police, here's some video we shot earlier today. there was a dark suv that had gone off the road, and it appears that the air bags inside had deployed, and there was a tarp covering a figure on the ground. as it pulled away, i did see damage to the front passenger side of the vehicle. the other vehicle was a blue sedan, which had extensive damage. fire officials tell me there was a gunshot victim at the scene and hayward police transported one victim to the hospital. that victim had minor, to moderate injuries. we do not know if that person had any kind of gunshot wound.

we did talk with one woman who says she was about a half block away, and she tells me, she heard a loud noise that sounded like metal. >> in front of me was this car, this suv, two doors open. police everywhere. watched the crime scene investigators come in and take pictures. >> reporter: right now, you can see the traffic has resumed here, but there are still two police vehicles that are here, and some crime tape. i have learned that police are at the police headquarters right now, and i've found out that there are some people that they are interviewing. whether they were directly involved, or whether they are witnesses, we're still trying to find out as investigators try to piece together what happened here. but for now, we know at least one person dead here. an another taken to the hospital. we are trying to gather more information, and will bring the details to you tomorrow morning

on ktvu morning news. for now, reporting live in hayward, jana katsuyama, ktvu, channel 2 news. about an hour ago, caltran closed part of southbound highway 280 in san francisco. the closure is between the king street onramp to just before caesar chavez street, and runs through the weekend. crews are working to restore a badly worn hinge. the freeway is a favorite route for giants fans heading to at&t park. there are home games this weekend, and caltrans is encouraging people to take muni, b.a.r.t., or caltrain. >> definitely don't want to head that direction and get stuck on king street and realize i can't get on the

highway. >> you can always monitor backups and get live routes on ktvu.com, just chick on the traffic section. three teenagers got stranded on a school field trip and hike. the hikers got stuck, climbing the face of the anderson dam. a word of caution for those headed outdoors this holiday weekend. >> reporter: julie, this park is expected to be packed for memorial day. the trails here can be very inviting, with its scenic views, yet, looks can be deceiving. if you aren't careful, you could end up in harm's way. news chopper 2 caught the dramatic rescue of three teens in distress. the treeo at the anderson reservoir dam. >> it's a fairly tough climb. a lot of loose shell. the beginning is not, but you get about three quarters of the way up, and you have no choice

but to continue. you'll see that ledge. >> reporter: 200 feet up the hillside. cal fire, san jose fire, santa clara county fire, all trying to get them to safety. one of them with a helicopter, the other two harnessed in, and roped down. >> we couldn't get to them, either top or bottom, so it was the terrain, also due to location. and us getting stuck, pretty much stuck in the same predicament. >> reporter: the teenagers there for the end of the school year picnic got separated from the school chaperon. park rangers saying the teens did the right thing, by staying put, and calling for help, but the wrong thing by getting there in the first place. >> i just can't believe it, really, because it doesn't seem like there's that much to get in trouble there. >> reporter: the area, off limits with no trespass signs posted. a stern reminder to be aware of your surroundings, as the scary

ordeal could have been avoided. >> you never want to go off the beaten path, because sometimes you can get in trouble. i think thankfully, there were rescue teams that were really trained. hopefully, people learn and follow the rules. >> reporter: while it didn't happen in this case, santa clara county park rangers tell me, trespassers could be fined hundreds of dollars. not to mention, have to pay for the rescue operation. reports live in morgan hill, ktvu, channel 2 news. there is still some real tension tonight in salinas, following a deadly shooting early this week. today police defended their actions. new surveillance video shows the chaotic moments from the most recent police shooting on tuesday. police say the suspect, carlos mejia was holding gardening sheers. this is the second police shooting in the last two weeks, and the third since the againing of the year. and community members say they

are angry. >> just like terrorists. they are behaving like terrorists. they are terrorizing our town with their behavior. >> reporter: during a demonstration last night, someone in the crowd shot and killed a protester. a police officer performing cpr on the victim was then injured by an object that was thrown from the crowd. salinas police say they will forward reports on the shootings to the fbi and the justice department for further review. an investigation into a school confrontation heated up today, when one of the attorneys called a 12-year-old boy a liar. delia garcia-bratcher is accused of confronting the boy, and grabbing his throat after he allegedly bullied her daughter. the mother appeared before a judge today. the woman's attorney says the boy made up the story. >> she never laid hands on this boy, that is what must be made clear. she did ask him to stop bullying her daughter. she did not get the wrong boy.

the boy is lying. >> the attorney says his client was just protecting her 10-year- old daughter. there is a lot of talk going on in brentwood, because of a picture in a high school yearbook. ktvu's john sasaki tells us, a teacher dressed up like trayvon martin for his yearbook photo. >> reporter: as classes let out for the day at brentwood heritage high school, students were more excited than usual, because the 2014 yearbook came out this afternoon. very quickly, a hot topic was this portrait taken by spencer smith. >> i think it's okay that like he did it, but not in the yearbook. >> yeah, he could do it at his house. but not in the yearbook. >> reporter: smith is dressed like trayvon martin, the florida teenager killed by jordan zimmerman in 2012. >> i think it's a good idea, because he's expressing himself. that's the whole point of yearbook pictures, you're

supposed to express yourself. >> reporter: but the yearbook is the year in review, mostly for the students at heritage. >> i think that's very inappropriate for a yearbook. this is supposed to be capturing the best moments of the year. and you know, all positive things. >> reporter: the few parents who talked with us, thought the yearbook was not a good place for this kind of statement. >> i am kind of sad about it, that it had to go to be put in the yearbook. >> i think you could take it different ways, but i think a high school yearbook, probably as a teacher, is not the place to make your stand. >> reporter: zimmerman was tried for murdering martin, but last summer he was acquitted in the racially charged case. >> i don't know what message he was trying to show, but i think he just wanted to draw more attention to it. >> reporter: i tried to contact mr. smith about why he dressed this way, but he was gone for the day. the school principal told me he learned just about it this day, and that he would have to look

into it before commenting. new developments tonight involving a man who was accused of holding a young woman captive in southern california for ten years. today, that man appeared in court. and the judge ordered him held on $1 million bail. prosecutors say he is a psychological torturer, but some neighbors are disputing those claims. >> reporter: the woman says this man was her mother's boyfriend until prosecutors said he drugged, and kidnapped her in 2004. 42-year-old isidro garcia, now charged with five felony counts, including rape and kidnapping, making an initially court appearance thursday in california. police spent ten years looking for the unnamed woman, while she was allegedly subjected to mental, and physical abuse. garcia is said to have held her against her will. threatening deportation if either was caught. >> on two occasions she tried

to escape. he caught her and she was beaten for her efforts. >> reporter: the kidnapping happened in santa ana. they were living some 20 miles from her home. prosecutors claim garcia forced her into marriage, and made her have his baby of the police say she recently found her sister on facebook, and her mother convinced her to call police. some neighbors who saw the couple are skeptical. >> we would always see them happy. she would go to work. >> reporter: garcia's lawyer says the unnamed wife fabricated all of these claims because the couple was breaking up. >> there's pictures on facebook of her and her mother weeks ago. why is she saying she never knew her? her mother would come over also. >> garcia's arraignment has been postponed until june 9. faces up to 19 years in prison if convicted. the u.s. postal service issued a stamp today honoring a hero of the lgbt community.

harvey milk, the late san francisco supervisor. the city's castro district held its own unveiling this evening. harvey milk was one of the country's first gay elected politicians. he was in office less than a year though when he was assassinated in 1978. today would have been his 84th birthday. his nephew spoke when the stamp made its official debut at the white house. >> much like mlk, martin luther king, uncle harvey had a dream, for which he knew he would not physically get to see come real. >> the white house doesn't hold stamp dedication ceremonies like today's very often. in fact, the last one was in 2008 for a baseball stamp. back in san francisco this morning, people lined up at the castro district post office to buy the new harvey milk stamp. when a pregnant woman goes into a coma, what happens to

30 home invasions since the beginning of this year, including a handful just this month alone. that's the situation facing oakland police saying it's on the rise in certain parts of the city. she talked with the victim of the most recent home invasion robbery. >> reporter: police are urging residents to be extra careful when going in and out of their homes, and when they open the front doors. i spoke with the victim about

her frightening ordeal. this is known as the redwood heights neighborhood. single family homes on tree line streets, nestled between highway 580, and 13. home, was the sanctuary until saturday. >> the biggest shock of it all was that it happened in broad daylight. >> reporter: there was a knock on the door. a family member opened the door just a crack, and that's all it took. >> the momentum of him opening the door, and the guy kicking it in at the same time. >> reporter: from the woman's 5- year-old daughter, to her 75- year-old father. >> they kept saying, where is the money? >> reporter: the victim said the nightmare lasted 20 to 30 minutes but seemed like an eternity. >> they had their guns to my back, and it was really nerve wracking. one of the guys escorted me

back to my room, he popped his gun with frustration. >> reporter: items the family worked hard to buy, but a loss she says could have been much greater. >> to me, six lives. that's like a small price to pay. i tried to make sure they saw the human side of us. >> reporter: neighbors say surveillance cameras did capture the getaway car. police asked us not to release it. the victim has this advice. >> don't play the hero. just get them in and out of the house as soon as possible, and make sure you are safe and your family is safe, and that's the only thing that matters. >> reporter: the family installed a security door the day after the home invasion robbery, but there is a lingering fear that the gunman will return. this evening, we saw one neighbor getting an alarm system installed, telling me she's doing everything she can

to protect her family too. reporting live, in oakland, amber lee, ktvu, channel 2 news. a man who drives an ice cream truck is accused of trying to sell way more than just ice cream in brentwood. police arrested 62-year-old kelly robin brown of oakley yesterday. investigators said they got a call from another man who said brown tried to sell them methamphetamine when he ordered some ice cream. brown was later found at a gas station parking lot, and taken into custody. santa clara county is suing five big drug makers for what it calls a campaign of deception for the use of prescription painkillers. the lawsuit was filed by attorneys for santa clara, and orange counties. both of overwhelm claim trug makers have promoted the use of narcotics without the risks. this morningk one attorney tabbed about what that has

meant in santa clara county. >> we've seen increases in overdose deaths. we've seen babies born with withdrawal. skyrocketing medical costs, and rampant crime. >> the use of these drugs has created a population of addicts. it's also created a resurgence in the use of heroin, which creates a similar, but cheaper result. officials say pleasanton's new drought center is receiving a hundred calls a day. residents are asked to cut back their water use by 25%. >> most people haven't really focused on it. once they got the paper in the mail, they finally said wow, this is real, and this could really affect me. >> the drought center is helping homeowners analyze their water usage.

a popular destination for bay area families tops the list of the state's most polluted beaches. cowl beach was named the most polluted beach in the entire state, by the heal the bay organization. nearby capitola beach also made the top 10, along with marina lagoon. wind surfer circle near candlestick point, and pillar point harbor. most bay area beaches though, got good grades. heal the bay, says california's drought has helped shore line water quality. less rainfall, means less runoff, and lower levels of bacteria in the water. temperatures today about where they were yesterday. we had some mid-80s inland. 84 in antioch. highs around the bay, mostly in the low to mid-70s. as we move into tomorrow, a warmer day. friday, it will be warmer than it was today by a few degrees. fog along the coast right now. the reason for the warming is

the fog is still there, but it's starting to pinch down. i looked at some of the soundings, and profile imagery. the fog has really pinched down. that means we're not going to see as much fog tomorrow morning when you wake up, which means an earlier burnoff, which means a warmer day. it's just that simple. tomorrow morning, when you wake up, there will be fog in a lot of places. it's going to burn off quickly. temperatures outside are in the 50s. the fog forecast for the morning hours, you'll see the footprint here. i think it's a little aggressive. the fog shouldn't get much past the oakland hills. concord, you're going to wake up clear. napa, santa rosa clear. even some low 90s showing up in the inland bay valley. we continue with this warm as we head into your bay area holiday weekend. when i come back, we'll map out your saturday, your sunday, and

to at least know i've got one of them now. >> reporter: wes is a healthy 5- pound 9 ounces. despite her drowsy state. >> she was able to reach up and touch my face. she puckered for a kiss which was interesting as we waited for months. >> reporter: melissa's treatment will be a long and expensive process. putting this santa cruz county sheriff's deputy in a position he's not used to. >> my kind of work, i'm used to always being in control. it's hard being the one that needs to have other people swoop in and help. >> reporter: help carrying for a seriously injured wife and their first child. >> got his mom's nose, and mom's ears. he's opening his eyes, and looking around already. >> reporter: as wes becomes more alert in the coming

new at 10:00, the fight over a planned development in the north bay is heating up. tonight, more than 500 people showed up to a public hearing to voice their concerns. the crowd of people packed a middle school gymnasium. they're concerned about plans to expand a mixed use development in an already congested area. debra villalon joins us with what's at stake. >> reporter: julie, what's here now is a shopping center. and offices and an apartment, larkspur landing hasn't changed much over the years. but a blueprint to expand is having a rough landing. people arrived tonight already riled up. not because a particular project is on the table. but because they oppose a planning process that could

open the door to one. >> it can sit there, if certified as a ticking time bomb to be used in future decisions. >> reporter: at stake, the area between the ferry terminal and the san rafael bridge. next comes the smart train. larkspur, its last stop. >> the idea had been if you have the train, the ferry boat, all of these transit connections, you'll want to look at, should you be doing something different with infrastructure, development, all of these things? that's how it started. >> reporter: there is more of a willingness to welcome develop, so people can live, shop, and eat in places that's always had more potential. >> it's always just been sort of desolate, out of the way, and you know, you go to take the ferry, or not much. >> i would like to see a show of hands in this room, of

people who are opposed to the plan. >> reporter: but the 500 people who packed this gymnasium. says any planning that adds traffic to an already congested freeway is irresponsible. >> we welcome affordable housing. this is not about not welcoming people. people are welcome in marin. >> when we tied on a single threat, we find it is all connected. all of our communities in marin are connected. >> why would we want to tax an already limited water supply? >> reporter: critics point to the wind cup apartment complex in neighboring corte madera as an example of an eyesore, and bad planning. it turns out larkspur's plan could be even more dense than that one. the city council won't get this until fall. oppositions likely to go

stronger. and they got an earful tonight. hewlett-packard announced today it is laying off between 11 and 16,000 workers. the palo alto based company says the cuts are part of a major restructuring plan. they did not say where in its worldwide operations those cut backs will take place. the company also reported revenue is down in the 2nd quarter. 2 investigates the danger of lithium-ion batteries. the national transportation safety board says there needs to be more testing. why the flying public needs to know about this. >> reporter: earlier this week, we showed you tests of lithium batteries failing, burning and exploding. the same type of batteries used to board the new 787 jetliner, which underwent a resign to use air to cool the batteries to prevent runaway fires.

uc engineering professor, and senior lawrence berkely battery engineer tells us he doesn't believe the resign went far enough. >> i think the much better design would be to have a liquid coolant system that can provide a much greater rate of heat removal so that if any one of the cells begins to overheat for whatever reason, that overheating will not be transferred to adjacent cells. >> reporter: today, the ntsb went much farther saying the process is used in 2006 to support the certification of the lithium-ion battery designed for the 787 were inadequate. first, conduct short circuit tests onboard some aircraft, not in a lab, to assure the resign would really prevent a domino affect fire throughout the battery cluster.

test all permanent lithium batteries. develop better battery test standards. review the battery certification process, and appoint an independent oversight panel. this all comes about a year after the federal aviation administration pronounced the batteries safe for passenger flights. >> this has a certain sense of urgency to it. >> reporter: carol sterns, says he believes the ntsb, which can only make recommendations is trying to force the faa and boeing to do all of these things. >> the ntsb is saying wait a minute, we're not entirely happy with the work you've done on the 787. we're very concerned that any lithium powered aircraft can have problems. they think these things are not safe yet. >> reporter: in a statement issued today, boeing said, we remain confident in the safety and integrity of the battery solution, which was developed by boeing, and approved by the faa last year. tom vacar, ktvu, channel 2 news. our coverage continues on ktvu.com, you can watch our

original report about the dangers of lithium batteries, and the raw video of battery testing that we obtained. the house voted to rein in the national security agencies collection of phone records. the bill passed. it limits the nsa's ability to collect and store land line records up to 18 months, and gives them access to many phone records. the bill was a compromise between the white house and conservative republicans. it goes to the senate, where its fate is uncertain. the tiny blue lizard has a laptop, and reminds users to choose between friends and public for status updates. the default has also changed to friends. it's been set at public since 2009. facebook will also roll out an expanded privacy checkup tool in the next few weeks.

san mateo county's antiterrorism team is back from a competition. they were among the only u.s. team among 30 other teams. it was a chance to learn new training. and providing advice and support. the military in thailand staged a coup today. >> is there a real coup going on? >> inside, the military had been meeting with rival political leaders, and then detained them. soldiers then spread out

a lesson in paying it forward. this 26-year-old man grew up in foster care in the bay area. now he fosters a teen of his own. so many foster children don't get the help they need, but as ktvu's rob roth shows us, this one case serves as an inspiration to many to never

give up hope. >> reporter: bucking the odds. he coaches kids basketball and he teaches in an oakland charter school. but perhaps most remarkably, he grew up in a foster home, and is now a foster father himself. >> this is only the beginning. i see myself doing a lot of great things. >> reporter: he was only 7 years old when an alameda court took him away from his drug addicted woman and put him in a foster home. >> i was pretty angry. >> reporter: he was placed with mildred walls. >> i held onto him no matter what he did. i think he recognized that. >> when i was breaking things, and being a knuckle head, she stuck with me. >> reporter: deon has taken in a 15-year-old boy. >> i can deal with things so

when my son is depressed, i used to be depressed when i was his age. >> he's getting back some of the things he did to me. >> reporter: he hopes his foster son won't be a statistic. 30% end up homeless as adults. here's one more statistic. the number of post traumatic stress disorder cases among former foster care kids is double that of combat veterans. but deon overcame it, and perhaps other foster kids can do. >> when we look at what helped him get through his challenges, those are the kinds of services and support that we can look to replicate. >> reporter: deon wants to become a police officer, but -- >> being a foster parent, that's me.

>> reporter: in oakland, rob roth, ktvu, channel 2 news. marine researchers plan to examine the remains of a young humpback whale. it has drawn a stream of curious onlookers since it was first spotted yesterday. it's about 25 feet long, and may be two or three years old. they're waiting for it to wash onshore, before they get a closer look. it's hoped that happens tomorrow, and a necropsy can be determined why it died. hopefully, they'll get that necropsy done pretty soon. temperatures today, they were about where they were yesterday. not much of a difference. numbers were mostly in the 70s, and low 80s. a little warmer. tomorrow is going to be warmer. how do i know? the coastal fog is starting to pinch fountain down. this low pressure system pretty
